摘要:
教育强国必须依法治国。心理健康教育立法是教育强国、心理健康教育可持续发展的必由之路。本文从我国心理健康教育立法的基础和现状入手,梳理国外相关立法经验,以期从历史发展经验和未来发展规划角度,明确心理健康教育立法的可能性;以社会现实的迫切需求为起点,回应教育政策与法律互联互动的需要,立足心理健康教育可持续发展的愿景,分析我国心理健康教育立法的必要性;并对心理健康教育的立法基础、立法内容和立法路径进行了初步讨论,进一步论证了我国心理健康教育立法的可行性。据此认为,我国心理健康教育立法势在必行,其立法思路应在“见微知著”、立法内容贵在“与时俱进”、立法策略重在“高瞻远瞩”。
Abstract:
To build a strong country in education, governance must be rooted in the rule of law. Legislation on mental health education is the necessary way for achieving a strong country in education and the sustainable development of mental health education. This study starts from the foundation and current situation of the legislation of mental health education in China, combs through relevant legislative experience of other countries, and clarifies the possibility of mental health education legislation from the perspective of historical development experience and future planning. It analyzes the necessity of mental health education legislation in China based on the urgent needs of social reality, the demand of interconnection between education policies and laws, and the vision of sustainable development of mental health education. It also conducts a preliminary discussion on the legislative foundation,content, and path of mental health education,further demonstrating the feasibility of such legislation.Accordingly, it is believed that mental health education legislation in China is imperative, with the legislative approach emphasizing “insight from the small,” the legislative content focusing on “keeping pace with the times,” and the legislative strategy prioritizing “foresight.”
