作为高等教育治理理论创新的基本前提,话语体系的反思与转换体现在宏观语境、中观议题和微观工具等三个方面。首先,要实现从“西方中心”到“中国立场”的语境转换,立足高等教育发展不平衡不充分的现实,既要强调自主办学和社会参与,也要发挥政府在规则制定、公平保障、纠纷化解等方面的“元治理”作用。其次,要实现从“结构主义”到“规则逻辑”的话题拓展,传统高等教育治理研究在府学关系的二元结构中建立起问题意识和理论议题,但忽视了治理过程的动态机制和权力运作的多样性差异,亟待嵌入规则视角,从不同行动者的微观互动、博弈之间窥探高等教育治理机制及其演进。再次,要实现从“硬法之治”到“软硬混治”的工具变迁,教育法治的实现既要坚持教育法律(“硬法”)的立改废释和有效执行,也离不开教育政策(“软法”)的宏观指引和微观落实,通过二者的衔接协调、互补谐变方能彰显高等教育治理的专业性和特殊性。
Abstract:
As the basic premise of the innovation of higher education governance theory, the reflection and transformation of the discourse system are embodied in three aspects: macro context, meso issues and micro tools. First of all, we should change from a “western-center” context to a “Chinese-oriented” context. Given that the development of higher education is unbalanced and inadequate, we should not only emphasize the autonomy of higher education institutions and the participation of the market, but also let the government play its role in “meta governance” in rules-making, fair guarantee, and dispute resolution. Secondly, we should expand the discussion topics from structuralism to rules and logic. The traditional higher education governance research has established the problem consciousness and theoretical issues in the dual structure of the relationship between the government and the higher education institution. However, it ignores the dynamic mechanism of the governance process and the diversity of power operations. It is urgent to embed the view of rules to explore the mechanism and changes in higher education governance from the perspective of micro-interaction and game among different actors. Thirdly, we should change our thinking from “the rule of hard law” to “the mixed governance of soft and hard law.”The realization of the rule of law of education should not only adhere to the formulation, modification, abolition, interpretation and implementation of education laws, but also be inseparable from the macro guidance and micro implementation of education policies. Only through the convergence and coordination of the two can the professionalism and particularity of higher education governance be highlighted.
