我国校园欺凌治理的制度缺失与完善-清华大学教育研究

摘要:: 近年来，连续发生的校园欺凌事件，折射出反校园暴力与欺凌法律缺失、刑事惩罚和教育矫治弱化、学校法制教育和监管机制不完善等问题。对此，有必要完善有关防治校园欺凌方面的法律法规；合理适用收容教养、教育矫正等少年司法制度；公安、教育等部门加强工读学校设置和管理、校园暴力数据库与快速处置等方面的制度建设；学校要成立安全管理委员会，开展法制教育，并建立暴力预警与处理机制；在提升父母家庭教育能力的同时，建立对拒不履行监护职责父母的责任追究制度等等。

Abstract:: In recent years, the continuous occurrence of campus bullying reflects the lack of law, weaknesses of legal punishments and educational correction, and the imperfection of school legal education and supervision system. Therefore, several efforts need to be done on the prevention of campus bullying: firstly, relevant legal laws should be perfected. Secondly, juvenile justice system and related educational correction should be adequately adopted. Thirdly, data achieve and data base in this regard should be established and maintained by police and school security departments. Fourthly, a certain committee of school security management should be built up in schools to give legal education and develop a violence warning and coping system. Finally, while family education is strengthened, it is also necessary to a legal system to supervise and check parents’ guardianship responsibility.
