我国企业合规改革试点已取得长足发展,但该制度尚未适用于民办学校。考虑到单位犯罪对民办学校的存续发展具有重大影响,“水漾效应”突出,有必要在民办教育领域引入合规改革并对其制度设计进行初步探索。在民办教育领域引入合规改革有利于保护利害关系人的权益,塑造民办学校的合规文化,也体现了我国依法支持和规范民办教育的基本方针。该制度引入初期可先适用于民办学校的单位犯罪,而是否适用于民办学校内部人员单独实施的犯罪需进行分类探索。由于民办学校规模较小,宜采取“专项合规”模式。民办学校的合规改革可借鉴企业合规改革中的第三方监督评估机制,由民办教育工作联席会议承担第三方机制管理委员会的职能。
Abstract:
China’s enterprise compliance reform has made significant progress, but it has not yet been applied to private schools. Considering that unit crime has a significant impact on the survival and development of private schools, and that the “ripple effect” is prominent, this paper proposes applying compliance reform to private schools in China and addresses a few critical issues in such an application. The introduction of compliance reform into the field of private education helps to protect the interests of various stakeholders of private schools, improve the school governance structure, and cultivate a compliance culture in schools, which is consistent with the trends in private education regulation in China. At the beginning of the introduction of the system, the application of compliance reform should be limited to unit crimes in private schools. Whether it can be applied to crimes committed solely by private school personnel needs to be further explored. Due to the small scale and limited resources of private schools, the “special compliance” model is more appropriate. The compliance reform of private schools can be learned from the third-party supervision and evaluation mechanism in the compliance reform of enterprises, and the joint conference of private education work can assume the function of the management committee of the third-party mechanism.
