摘要:
合法性是制度移植获得认同的前提条件。本文从合法性视角审视终身教职制度中的“非升即走”机制,阐述其在美国的思想、文化、法理和组织四大合法性基础。目前,美国“非升即走”合法性的价值导向正从法理型转向效率优先。在中国,“非升即走”的合法性已具有绩效基础,但在合法律性、文化基础、价值理念和程序制度等方面面临合法性危机。要堵住其合法性资源缺失,需重塑“非升即走”的合法性基础,从强调制度选人的效率优先价值导向转向注重合法律性价值导向,构建法理型合法性,基于学术立场优化教师选聘机制,完善教师评价制度。
Abstract:
Legitimacy is the prerequisite for the recognition of system transplantation. This paper examines the “up-or-out” mechanism in the tenure system from the perspective of legitimacy, and expounds its four foundations of legitimacy in the United States: ideology, culture, jurisprudence and organization. In the United States, the value orientation of the legitimacy of “up-or-out” is shifting from legal principle to efficiency priority. In China, the legitimacy of “up-or-out” has a performance basis, but it is facing a legitimacy crisis in terms of legality, cultural basis, values and procedural systems. To stop the lack of legitimacy resources, we need to reshape the legitimacy foundation of China’s “up-or-out” from emphasizing the efficiency priority value orientation of system selection to legitimacy value orientation, building legal legitimacy, optimizing the teacher appointment mechanism based on academic position, and improving the teacher evaluation system.
