作为更广泛的公共领域改革的重要组成部分,高等教育监管的复杂性根植于国家角色的多元性和动态演变属性。维系自治、权利保护与公共责任,构成高等教育监管的三重正当理由。高等教育监管失灵的根源在于,自治、权利与责任之间的协调困境。以透明、优质、创新等要素构成的责任导向,强化了大学自治的规范负荷,加剧了大学治理中的权力(权利)冲突。而以可及性、职业安全、隐私权、知识产权与反歧视等为基本主张的权利时代的到来,也不可避免地重塑了大学治理的形态。采取更加“精明”的高等教育监管策略,加强对高等教育监管机构的监管,提升高等学校的机构能力,构成高等教育监管走出迷思的必由之路。
Abstract:
As an important part of broader public sector reform, the complexity of higher education regulation is rooted in the pluralistic and dynamically evolving nature of the state’s role. The maintenance of autonomy, the protection of rights, and the orientation of responsibilities constitute three legitimate reasons for higher education supervision. The root of the failure of higher education regulation lies in the dilemma of the coordination between autonomy, rights, and responsibilities. The responsibility orientation composed of transparency, quality, and innovation strengthens the normative load of university autonomy and intensifies the power (right) conflict in university governance. The arrival of the era of rights with availability, occupational safety, privacy, intellectual property, and anti-discrimination as the basic claims has also inevitably reshaped the form of university governance. The only way for higher education supervision to get out of the myth is to adopt a more “smart” higher education supervision strategy, strengthen the surveillance of higher education regulation institutions, and improve the institutional capacity of higher education institutions.
